The Policy outlines the circumstances in which public health organisations (PHOs) are to refer issues to the NSW Health Clinical Ethics Advisory Panel. The Policy also provides guidance to PHOs that have chosen to establish clinical ethics advisory committees in respect of some or all of their activities. The Policy explains that establishment of such committees is not mandatory, however if a PHO does establish a clinical ethics committee it is to ensure it is constituted, operated and governed within the parameters set by this Policy.
Health Services Act 1997 NSW
NSW Govt Provides for the creation of area health services in NSW, their control and management, including the appointment of the Chief Executive who can create committees such as the clinical ethics committee. The Act also provides for the recognition of affiliated health organisations and statutory health corporations.

The functions of AHEC, as set out in Section 35(3) of the NHMRC Act, are:
§ to advise the Council on the ethical issues relating to health; and
§ to develop and give the Council human research guidelines under subsection 10(2) of the NHMRC Act; and
§ any other functions conferred on the Committee in writing by the Minister after consulting the CEO; and
§ any other functions conferred on the Committee by the NHMRC Act, the regulations or any other law.
